Parcom Service Contract
(or Service Level Agreement)

Defined Terms
The following words used in context of the Service Contract are defined as follows:
 
"Provider"
Parcom
 
"Client"
The person or entity who is applying for Parcom services

Agreement

This "SLA" is a "living document".  All customers agree to the fact that due to the nature of the Internet, slight changes to the SLA must be made from time to time to accommodate any change in the industry.  Changes/reviews to this document is done quarterly.

 

The Provider agrees to provide, and Client agrees to receive, access to the Parcom services according to the following terms and conditions:

1.  Client will use Parcom services in a manner consistent with any and all applicable laws of the State of Washington and the US Federal Government.

2.  Provider reserves the right, in its sole discretion, to deactivate the Client's account(s) upon an indication of credit problems including delinquent payments.

3.  THE PROVIDER SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. THE PROVIDER GIVES NO WARRANTY, EXPRESSED OR IMPLIED, FOR THE PARCOM SERVICES PROVIDED, INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THIS EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY PROVIDER OR ITS PROVIDERS BEYOND THE FEES PAID BY CLIENT TO PROVIDER FOR SERVICES.

4.  Provider is not responsible for any damages arising from Client's use of Provider or by Client's inability to use Parcom's services for any reason.  THIS INCLUDES LOST E-MAIL DUE TO INTERNET LATENCY, CLIENT ISP PROBLEMS, OR OTHER OUTSIDE ISSUES THAT CANNOT BE Controlled by parcom.  PARCOM IS NOT RESPONSIBLE FOR CUSTOMER CODE ISSUES THAT DEAL WITH SECURITY AS WELL.   IT IS ALWAYS THE CUSTOMER RESPONSIBILITY TO KEEP THEIR WEB SITES SECURE USING STRONG PASSWORDS AS WELL AS USE THE LATEST scripting technologies available to them (CAPTCHA CODE, STRONG SSL USAGE, ETC.)   PARCOM PROIVIDES THE TOOLS IN THE MOST SECURE MANNER POSSIBLE, HOWEVER IT IS ALWAYS STILL THE CUSTOMER WHO IS RESPONSIBLE FOR THEIR OWN WEB SITE BEING AS SECURE AS THEY CAN POSSIBLE MAKE IT.   ABOVE THE SERVERS, PARCOM CANNOT POSSIBLY MAKE custOMER CODE 100% RISK FREE.   THIS IS A COMMON SENSE POLICY AS SECurity IS DEPENDENT ON HOW THE DEVELOPER OF THE SITE CAN MAKE IT SECURE.

5.  While Provider shall make every reasonable effort to protect and backup data for Client on a regular basis, Provider is not responsible for Client's files residing on Provider. Client is solely responsible for independent backup of data stored on Provider servers.   This is ESPECIALLY TRUE FOR E-MAIL.  PARCOM CANNOT POSSIBLY RUN BACKUPS EVERY MINUTE FOR EVERY MAIL MESSAGE SENT TO AND FROM OUR SYSTEMS.   PARCOM ROUTINELY BACKUPS OUR MAIL SYSTEM SETTINGS, BUT IT IS NOT POSSIBLE TO BACKUP EVERY MESSAGE DUE TO THE MILLIONS OF EMAIL SENT PER HOUR IN OUR NETWORK.   PARCOM REQUIRES EVERY CUSTOMER TO DOWNLOAD THEIR MAIL AND BACKUP LOCALLY.   STORING MAIL ON OUR SERVERS FOR LONG TERM USE IS DONE SO AT THE CUSTOMERS RISK DESPITE PARCOM DOING EVERYTHING IN ITS POWER TO MAINTAIN ALL DATA INTEGRITY. 

 

Regarding Web site backups:

 

Parcom does a best effort backup solution for all true web site content.  We do not backup music, video, disk images, compressed files (zip, rar, etc.) as part of the backup solution is to protect the server and the web sites, not personal storage related files.   although some movies and music may be considered part of a site, parcom chooses to not back these up as part of the free best effort process.   customers should always have a backup of their own files.

 

database backups are available via the web based interface for self serve backups.

6.  CLIENT HEREBY AGREES THAT ANY MATERIAL SUBMITTED FOR PUBLICATION ON PROVIDER THROUGH CLIENT'S ACCOUNT(S) WILL NOT VIOLATE OR INFRINGE ANY COPYRIGHT, TRADEMARK, PATENT, STATUTORY, COMMON LAW OR PROPRIETARY RIGHTS OF OTHERS, OR CONTAIN ANYTHING LIBELOUS OR HARMFUL. ANY POTENTIALLY ILLEGAL ACTIVITY MAY BE BE DEACTIVATED WITHOUT WARNING BY THE PROVIDER. CLIENT HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS THE PROVIDER FOR ANY CLAIM RESULTING FROM THE SUBMISSION OF ILLEGAL MATERIALS.

7.  CLIENT HEREBY AGREES THAT ANY MATERIAL SUBMITTED FOR PUBLICATION ON PROVIDER THROUGH CLIENT'S ACCOUNT(S) WILL NOT CONTAIN ANYTHING LEADING TO AN ABUSIVE OR UNETHICAL USE OF THE PARCOM PRODUCT(S) OR THE HOST SERVER(S). ABUSIVE AND UNETHICAL MATERIALS AND USES INCLUDE, BUT ARE NOT LIMITED TO PORNOGRAPHY, OBSCENITY, NUDITY, ADULT ORIENTED, VIOLATIONS OF PRIVACY, COMPUTER VIRUSES, AND ANY HARASSING AND HARMFUL MATERIALS OR USES. CLIENT HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS THE PROVIDER FROM ANY CLAIM RESULTING FROM YOUR PUBLICATION OF MATERIALS OR YOUR USE OF THOSE MATERIALS. PROVIDER MAY OR MAY NOT GIVE NOTICE BEFORE DEACTIVATING THE USE OF AN ACCOUNT(S) WHICH THE PROVIDER DECIDES IS AN ABUSIVE OR UNETHICAL USE OF THE PARCOM ACCOUNT(S) OR HOST SERVER(S).  PARCOM RESERVES THE RIGHT TO NOT REFUND ANY FUNDS IF A CUSTOMER BREAKS THIS RULE.

NOTE ON VIRUSES:  Virus PROTECTION IS THE RESPONSIBILITY OF EVERY PARCOM CUSTOMER.   PROPER USE OF POPULAR COMMERCIAL ANTI-VIRUS SOLUTIONS IS HIGHLY RECOMMENDED FOR ALL CLIENT MACHINES ACCESSING THE PARCOM NETWORK.   ANY VIRUSES CONTRACTED THROUGH THE PARCOM NETWORK IS STILL THE RESPONSIBILITY OF THE CUSTOMER NOT PARCOM.   

8.  Due to the public nature of the Internet, all information should be considered publicly accessible, and important or private information should be treated carefully. Provider is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider or its customers may utilize.  PARCOM CANNOT AND WILL NOT SIGN NON-DISCLOSURES or LEGAL DOCUMENTS DUE TO THIS POLICY.   PARCOM IS ALSO NOT RESPONSIBLE FOR ANY SECURITY ISSUES THAT MAY ARISE FROM THE USE OF OUR SERVICES.   IT IS STRICTLY THE CUSTOMER'S RESPONSIBILITY TO PROTECT THEIR PRIVATE INFORMATION.   PARCOM IS ALSO OBLIGED TO PROVIDE THE US GOVERNMENT ANY ACCESS THEY SEE FIT DUE TO TIGHT SECURITY LAWS IN PLACE.   PARCOM COOPERATES 100% WITH THE US GOVERNMENT IF A CUSTOMER SITE REQUIRES AUDITING OF ANY KIND.   PARCOM ALSO CAN AUDIT ANY CUSTOMER SITE FOR ANY REASON IN ORDER TO PROTECT THE INTEGRITY OF THE PARCOM NETWORK.

9.  Use of distribution lists via unsolicited electronic mail or other mass electronic mailings or news group postings is strictly prohibited. The Provider reserves the right to deactivate the Client's account(s) upon an indication of such activity AS WELL AS NOT REFUND ANY REMAINING FUNDS UPON DEACTIVATION. Client hereby agrees to indemnify and hold harmless the provider from any claim resulting from the Client's or another party's use of electronic mail service(s) on the Client's account(s).

10. In the event it is necessary to refer any dispute to an attorney or resolve it in A court of law, parcom will be entitled to an award of reasonable attorney's fees and all costs associated with any legal action, whether or not a suit shall actually be filed or processed.  in other words, customers are 100% responsible for both parties in terms of all legal fees and associated expenses AHEAD OF TIME.   customers must file within the city limits where parcom does business (king county, WA).   any legal threats, filings, or correspondence discussing legal action by the customer requires an understanding that the customer must pre-pay attorney fees at the rate of $350/hour for a minimum of 3 corporate level attorneys assigned to parcom internet services, inc.   minimum hours of at least 20 hours PER ATTORNEY will be billed to the customer requesting legal action.   THIS IS A VERY STRAIGHT FORWARD POLICY.  IF A CASE SHOULD RESULT IN FAVOR OF PARCOM, CUSTOMER WILL ALSO BE RESPONSIBLE FOR ALL EXPENSES AND DAMAGEs ON TOP OF ATTORNEY FEES.


11. Provider maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to Client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.    Client who rents any Parcom IP addresses must immediately terminate the use of these IPs through third party companies (i.e. Domain registrars) if the client decide to terminate services with Parcom.  (CURRENTLY IP RENTAL IS NOT AVAILABLE BUT IP ADDRESSES ARE ASSIGNED TO HIGH END CUSTOMER SITES)   Parcom is not responsible for clients using hard coded ip addresses within their business practices, web site scripting, or any other networking task if parcom warrants the need to change an ip of a server for any reason.   PARCOM CAN CHANGE A CUSTOMER IP WITHOUT NOTICE AT ANYTIME.  THE REASON FOR THIS IS IP CHANGES CAN OCCUR DUE TO BACKBONE PROVIDER CHANGES THAT CHANGE WITH LITTLE TO NO NOTICE.   PARCOM WORKS EXTREMELY HARD TO KEEP UP WITH THE EVER CHANGING INTERNET AS WELL AS THE PROVIDERS THAT CHANGE IN THIS INDUSTRY SO QUICKLY.

12. Client agrees that if client disputes any credit card charges, Provider reserves the right, in its sole discretion, to deactivate the Client's account(s) without prior warning.   Client may also be billed the surcharges, materials, and wages involved in a credit dispute if client dispute is found unjustified.

 

13. Client agrees that if Parcom decides to cancel an account for breaking any of our acceptable use policies, that they will NOT receive a full money back guarantee as well as ALL remaining funds and any setup fees.  Any balance left on the account is automatically forfeited.   If the client disagrees with this policy and wishes to dispute it for any reason, all legal resolutions and fees associated with a legal resolution are to be paid for in advance by the client in full for both the client and Parcom.   PARCOM ALSO CONDUCTS SPECIALS FOR PRE-PAYING SOME SERVICES.  CUSTOMERS MUST UNDERSTAND THAT CERTAIN SPECIALS OR SETUP FEES ARE NON-REFUNDABLE.

14. If Client is not satisfied with Parcom SHARED HOSTING services within the first 30 days of service, provider will refund the rental/service fees not including any applicable non-refundable set up charges.  Optional items, dedicated servers, Static IP ADDRESSES, Private Label Service, and any one time fees paid are excluded.

15. PARCOM IS NOT RESPONSIBLE FOR CUSTOMER ERRORS WHEN PROCESSING DOMAIN REGISTRATIONS ON THEIR BEHALF.  HOWEVER, IF THE CUSTOMER IS USING A DIFFERENT REGISTRAR, THEY ARE 100% RESPONSIBLE FOR POINTING THEIR DOMAIN(S) TO THE PARCOM NETWORK.  AND THEY ARE ALSO RESPONSIBLE FOR TAKING OWNERSHIP OF THEIR DOMAIN PRIOR TO ADJUSTING THEIR DOMAIN TO WORK WITH THE PARCOM NETWORK.  PARCOM PROVIDES ALL DNS INFORMATION WITHIN THE SIGN UP PROCESS. THIS INFORMATION IS ALL THAT A CUSTOMER WILL REQUIRE TO POINT AN EXISTING DOMAIN TO PARCOM.     ACCOUNT SETUP FEES DO NOT INCLUDE DOMAIN PROCESSING OF ANY KIND.   PARCOM WILL NOT SUPPORT THE USE OF THIRD PARTY DNS SERVERS AS WELL.   PARCOM RESERVES THE RIGHT TO CANCEL CLIENT ACCOUNTS IF THE USE OF THIRD PARTY DNS SERVERS ARE USED.   NO REFUNDS ARE GIVEN IF THAT SHOULD HAPPEN.

16. PARCOM HAS EXCLUSIVE RIGHT TO RECOMMEND A HIGHER OR DEDICATED SOLUTION IF A CUSTOMER SITE MEETS OR EXCEEDS THE CAPABILITIES OF A SHARED SERVER.   PERFORMANCE SETTINGS ON ALL SHARED ACCOUNTS ARE PRE-DEFINED TO ASSURE QUALITY OF SERVICE FOR ALL CUSTOMERS.  NO ONE CUSTOMER CAN EXPLOIT OR USE A SERVER OR THE PARCOM NETWORK FOR THEIR EXCLUSIVE USE.  THIS INCLUDES THE BUILDING OF MULTI-SITE SOLUTIONS IN HOPES OF HOSTING MANY DOMAINS INSIDE OF ONE ACCOUNT.   IF A CUSTOMER STARTS TO USE ALL CPU AND MEMORY RESOURCES ALLOCATED TO THEIR ACCOUNT, PARCOM WILL RECOMMEND A HIGHER END SERVICE IF THAT SERVICE CAN PROVIDE BETTER PERFORMANCE FOR THEIR NEEDS.  IF THE HIGHEST END SHARED SERVICE IS NOT ADEQUATE, THAT CUSTOMER WILL POTENTIALLY REQUIRE A DEDICATED SOLUTION.   IF CUSTOMER IS NOT AVAILABLE FOR CONTACT, AND THE ACCOUNT CREATES PROBLEMS FOR OTHER CUSTOMERS, PARCOM RESERVES THE RIGHT TO SHUT DOWN A SITE TO PROTECT OTHER CUSTOMERS ON THAT SERVER.  THIS IS TO MAINTAIN OUR HIGH STANDARDS OF UPTIME AT PARCOM.

17. PARCOM'S ONE TIME SETUP CHARGES OR OTHER NON-RECURRING FEES ARE NON-REFUNDABLE.

18. Passwords are all kept with strict confidentiality in mind.   Customer passwords are kept securely on file for emergency purposes only.   Customers may reset their passwords for both mail and server access, however Parcom can reset passwords at our own discretion if an issue REQUIRES staff access into an account.  IT IS THE CUSTOMER RESPONSIBILITY TO MAINTAIN A HIGH LEVEL OF SECURITY BY USING DIFFICULT PASSWORDS FOR THEIR ACCOUNTS.   PARCOM IS NOT RESPONSIBLE FOR CUSTOMER SITES THAT ARE HACKED DUE TO POOR PASSWORDS.

19. PARCOM STANDARD SUPPORT PRACTICE: ALL SUPPORT REQUESTS ARE HANDLED MONDAY THROUGH FRIDAY DURING BUSINESS HOURS (PACIFIC STANDARD TIME).  ALL IN THE ORDER RECEIVED.    ISSUES THAT ARE SENT VIA THE EMERGENCY (ON CALL PAGER) SERVICE ON WEEKENDS, EVENINGS, AND HOLIDAYS ARE HANDLED VIA ON-CALL PERSONNEL 7X24.  A SERVICE FEE WILL APPLY AND BE BILLED TO THE CLIENT ACCOUNT THE SAME DAY.   PARCOM MAINTAINS a TIER 1 SUPPORT TEAM TO ADDRESS MOST ISSUES, HOWEVER IF THE CLIENT HAS ISSUES THAT REQUIRE TIER 2 OR TIER 3 TYPE SUPPORT AFTER BUSINESS HOURS, THEN EMERGENCY PAGING SERVICE FEES APPLY.

20. Parcom DOES NOT SUPPORT COLDFUSION OR COLDFUSION EXPRESS.

21. IN ORDER TO FULLY QUALIFY FOR THE 30 DAY GUARANTEE,  A CUSTOMER DOMAIN NOT REGISTERED THROUGH PARCOM MUST BE POINTING TO THE PARCOM NETWORK FOR THE ENTIRE PERIOD UP TO 30 DAYS.  ALL CUSTOMERS AGREE TO THIS POLICY THE MOMENT AN ACCOUNT REQUEST FORM IS RECEIVED FROM THE CUSTOMER.

22. PARCOM DOES NOT PROVIDE WEB DESIGN, SCRIPTING, OR DATABASE CONSULTATION ASSISTANCE TO ANY PARCOM CUSTOMER.   PARCOM WILL REFER SUCH INQUIRIES TO TRUSTED PARTNERS OR OTHER RELATED COMPANIES.   PARCOM ALSO PROVIDES FREE ACCESS TO OUR COMMUNITY FORUMS WHERE CUSTOMERS CAN ASSIST OTHER CUSTOMERS.  AS A PARCOM CUSTOMER, YOU UNDERSTAND THAT SCRIPTING OR DEBUGGING OF SCRIPTS IS AN EXPENSIVE OVERHEAD THAT PARCOM DOES NOT PROVIDE DUE TO OUR LOW PRICING.   IF A CUSTOMER INSISTS PARCOM DEBUGS A SCRIPT PROBLEM, WE RESERVE THE RIGHT TO CHARGE OUR STANDARD HOURLY RATE (CURRENTLY $250/HOUR).  NO GUARANTEES THAT OUR STAFF WILL SOLVE YOUR ISSUE(S).  HOWEVER WE COULD OUTSOURCE YOUR ISSUES IF WARRANTED.  FEES FOR THE OUTSOURCED PARTY IS THE RESPONSIBILITY OF THE CUSTOMER.

23. IMAP PRoTOCOL IS NOT SUPPORTED BY PARCOM.   IF YOU CHOOSE TO USE THIS PROTOCOL ON SERVERS THAT HAVE THIS FUNCTION AVAILABLE, YOU DO SO AT YOUR OWN RISK.

24. IT IS PARCOM'S SOLE RESPONSIBILITY TO DETERMINE WHICH FIREWALL PORTS ARE TO BE OPEN OR REMAIN OPEN FOR ANY PARCOM SERVERS.  THIS INCLUDES DEDICATED SERVERS.  IF PARCOM DECIDES THAT A CUSTOMER REQUEST FOR A PARTICULAR PORT BE OPENED, HOWEVER PARCOM WARRANTS IT BE A SECURITY RISK, PARCOM WILL ALWAYS BE THE SOLE DECISION MAKING ENTITY WHEN IT COMES TO PARCOM NETWORK SECURITY.   PARCOM CUSTOMERS ARE WELCOME TO REQUEST PORTS BE OPENED, HOWEVER IT MUST BE JUSTIFIED WITH KNOWING THAT THERE IS A VERY HIGH CHANCE THAT IT WILL NOT BE APPROVED.   STANDARD PORTS OPEN ARE: WEB, MAIL, DNS, AND OF COURSE ftp.    Everything else is not supported and has not been since 1997.  CUSTOMERS WHO FIGURE OUT WAYS TO "PROXY" THEIR WAY AROUND PORTS ARE NOT SUPPORTED AND FORFEIT ALL Support and REFUNDS FROM PARCOM IF PROBLEMS OCCUR.

25. PARCOM DOES NOT REQUIRE ANY CUSTOMER TO ADVERTISE FOR PARCOM.  ALTHOUGH CUSTOMERS ARE WELCOME TO DO SO.   NO BANNER OR POP ADS ARE REQUIRED TO BECOME A PARCOM Customer.  IN OTHER WORDS, A PARCOM CUSTOMER WEB SITE DOES NOT HAVE ANY ADVERTISING FOR PARCOM OR ANY OTHER COMPANY.

26. PARCOM does not guarantee availability of PLANS/services.  Parcom will do its best to notify clients via the web site if a particular plan may be sold out ahead of time.  due to the high demand of PARCOM services and due to the fact that PARCOM is a wholesale provider to the general public, PARCOM can only do its very best to assuring demand is met and that customers must understand this completely.   PARCOM is not responsible for being unable to meet demand for any reason.   this is true of any supply and high demand type scenario.   PARCOM will do its very best to providing quality services to everyone that wants to join our family.

27. PARCOM IS NOT AT LIBERTY TO DISCLOSE ANY INTERNAL PROCESSES OR PROCEDURES FOR OBVIOUS REASONS.   HOW WE MANAGE SERVERS, HOW THEY ARE UPDATED, HOW THEY ARE PURCHASED OR CONFIGURED ARE ALL CONFIDENTIAL INFORMATION.  CUSTOMERS, COMPETITORS, OR ANY OTHER VISITORS WILL NOT BE GIVEN ANY INFORMATION ABOUT OUR SERVERS IN ANY DETAIL. ALL BRAND NAMES, O/S SOFTWARE VERSIONS, BIOS VERSIONS, OR FIRMWARE VERSIONS, WILL TYPICALLY NOT BE DISCLOSED.   PARCOM DOES NOT DISCLOSE OUR SECURITY MEASURES, PRACTICES, OR HOW WE SCHEDULE SECURITY FIXES ON OUR Network.

28. PARCOM RESERVES THE RIGHT TO DELETE new ACCOUNTS IF AN ACCOUNT IS NOT USED WITHIN THE 30 DAY TRIAL PERIOD.  PARCOM WILL REFUND FUNDS ACCORDING TO OUR 90 DAY GUARANTEE MINUS ANY NON-REFUNDABLE FEES.  PARCOM WILL CONTACT THE CUSTOMER PRIOR TO DELETING THE Account, BUT IF WE RECEIVE NO RESPONSE, PARCOM WILL DELETE THE ACCOUNT TO AVOID CREDIT CARD ISSUES AND BILLING FRAUD.

29. SITES USING HIGH END ASP, CGI, PHP OR ASP.NET ARE TYPICALLY BEST SERVED BY OUR HIGHER PLANS DUE TO ISOLATED MEMORY SETTINGS, HIGHER RESOURCE SETTINGS, AND STATIC IPS.  IF YOU CHOOSE TO USE LOWER PLANS FOR SCRIPTING PURPOSES THAT DEAL WITH DATABASES, SITES WITH SESSION IDS, FORUMS, CHAT SYSTEMS, OR ANY OTHER INTENSIVE SITE REQUIRING MORE SERVER SIDE ACTIVITY, THEN YOU DO SO AT YOUR OWN RISK.   PARCOM Always SUGGESTS CLIENTS TO USE OUR HIGHEST END SHARED HOSTING PLAN FOR ANYTHING TO DO WITH SESSION id type SOLUTIONS.

30. PARCOM WILL NOT STORE DELETED ACCOUNT INFORMATION.  ONCE AN ACCOUNT IS DELETED, THE CUSTOMER UNDERSTANDS THAT BACKUPS ARE NOT AVAILABLE TO THEM.   THERE ARE NO EXCEPTIONS.

32. BACKUP INFORMATION FOR CUSTOMER CONTENT IS NOT GUARANTEED AS THERE ARE  FILES THAT CAN BE DIFFICULT TO BACKUP.   THIS IS ESPECIALLY TRUE FOR BUSY SITES THAT MAINTAIN A HIGH NUMBER OF "LOCKED" or USED FILES.  

32. BANDWIDTH and resource utlization IS NOT UNLIMITED.  CUSTOMERS UNDERSTAND THAT THEY ARE WORKING WITH RESOURCE LIMITATIONS BASED ON THEIR SERVICE LEVEL.  THE HIGHER THE SERVICE LEVEL, THE BETTER THE PERFORMANCE.   IT IS NOT PARCOM'S RESPONSIBILITY FOR CUSTOMERS CHOOSING THE WRONG LEVEL OF SERVICE FOR THEIR NEEDS.

33. PArcom reserves the right to remove components on its servers at any time if a component jeopardizes stability for all customers on the network.  third party components that are found to be incompatible with the operating system, other major third party software, or any other part of the system will be removed if found to be the source of any problems for parcom.   parcom does not have to notify customers, rather we will notify customers through our network status page.

THIS APPLIES TO UPDATES AS WELL.  IF VENDOR UPDATES PROVIDE NEW UNTESTED FEATURES, PARCOM RESERVES THE RIGHT TO DISABLE SUCH FEATURES UNTIL IT IS PROVEN TO BE STABLE.

34. PARCom reserves the right to refuse business to any customer due to customer not accepting billing, support, or any other type of customer service resolutions to issues.  this also applies to customers who do not wish to conduct professional correspondence with any parcom employee.   refunds, at our discretion, are given to such customers prior to dismissal.

35. PARCOM RESERVES THE RIGHT TO LIMIT THE NUMBER OF E-MAIL STORED PER ACCOUNT.   IT IS THE RESPONSIBILITY OF EACH PARCOM CUSTOMER TO DOWNLOAD THEIR MESSAGES AS THE MAIL SERVER IS NOT TO BE USED FOR PERMANENT STORAGE for years on end. AUTO-CLEAN FUNCTION IS IN EFFECT FOR DELETED and SPAM FOLDERS TO ASSURE QUALITY OF SERVICE TO ALL WHO SHARE mail space WITH EACH CLIENT.  It is the customer responsibility to download mail for backup purposes.

36. new or existing accounts: if a customer does not pay for services on time, parcom will delete the account - including all data and billing information.  THIS INCLUDES RESELLERS.

37. This applies to customers using outside e-mail addresses for contacting Parcom:
Due to customers toggling extremely high anti-spam filtering systems outside of our network, Parcom is not responsible for lost replies to you from our staff. If your ISP or custom client software blocks the parcom.net domain you must make sure this does not affect correspondence with Parcom.net. It is up to you to check any spam filters or "whitelist" the parcom.net domain to assure timely deliveries from our network to or through your ISP/network.

38.  Customers are responsible for their site content when requesting to move between server platforms.   Because of the differences between versions and platforms, parcom cannot be responsible for incompatibilities of customer scripts, databases, and other site content issues when moving between operating systems and servers.

39.  parcom does not have to notify customers of every emergency situation on the network.  ALTHOUGH WE DO OUR BEST TO NOTIFY OF ISSUES THAT CAN BE SCHEDULED.  parcom does all notifications via the network status page and FORUM exclusively.  AT TIMES WE ALSO USE THE CONTROL PANEL MAIL SYSTEM TOO.   it is the customer responsibility to keep up to date information via this page as well as request assistance whenever a network status issue affects their site.   customers are responsible for finding out which server(s) their site resides on too.  

40. PARCOM DOES NOT SUPPORT OUTSIDE NETWORKS IN TERMS OF CUSTOMERS CHOOSING TO UTILIZE OUTSIDE RESOURCES FOR THEIR SITES.   AN EXAMPLE WOULD INCLUDE THE USE OF OUTSIDE SQL DATABASE SERVERS TO SERVICE A PARCOM HOSTED SITE.  THIS IS TRUE IN REVERSE WHERE A PARCOM HOSTED SITE FEEDS FROM A REMOTE SQL SERVER.   PARCOM DOES NOT SUPPORT CLIENTS WHO USE OUR SQL SERVERS REMOTELY AND VOIDS ALL GUARANTEES AND SUPPORT AS WELL.  IT IS IMPOSSIBLE FOR PARCOM TO MAINTAIN A GUARANTEE THAT THE OUTSIDE NETWORK WILL REMAIN ONLINE FOR THE PARCOM NETWORK.  THIS IS ALSO TRUE FOR INDIVIDUALS WHO WISH TO REMAIN CONNECTED TO A PARCOM ACCOUNT (FTP FOR INSTANCE) FOR EXTENDED PERIODS OF TIME (DAYS, WEEKS, 7x24)  IT IS SIMPLY NOT POSSIBLE TO DO SO FOR SECURITY REASONS.

41. SHARED SSL ARE NOT TO BE USED FOR SHOPPING CARTS OR OTHER HIGH END RESOURCE INTENSIVE WEB SOLUTIONS.  THEY ARE MEANT FOR STAGING OR TESTING PURPOSES.   THE SHARED SSL FEATURE AT PARCOM IS A FREE SSL (OPEN SSL) SOLUTION THAT CAN ALSO BE USED FOR SIMPLE PRIVATE ENCRYPTION FOR FILE ACCESS, ETC.    SHARED SSL SHARE ONE COMMON RESOURCE, SO PERFORMANCE MAY VARY DUE TO MULTIPLE CLIENT USAGE.  FOR BEST RESULTS IT IS ALWAYS BETTER TO HAVE ONE PRIVATE SSL (QUICK SSL) PER SITE.

42. PARCOM CUSTOMERS ARE TO NOT USE THIRD PARTY MONITORING SERVICES TO CONSTANTLY MONITOR WEB, MAIL, FTP, OR OTHER SERVICES ON OUR NETWORK.   THIS IS DUE TO THE STRESS THESE MONITORING SERVICES CAN CREATE, WHICH IN TURN AFFECT RELIABILITY OF YOU SERVER YOU ARE UTILIZING.   IF A CLIENT IS FOUND TO USE SUCH A SERVICE, WE WILL BLOCK THE SERVICE AND CANCEL THE ACCOUNT WITHOUT PRIOR NOTICE.  NO REFUND WILL OCCUR.  THIS IS STRICT DUE TO THE PROBLEMS MONITORING SERVICES CAUSE AND HOW POORLY MOST OF THESE MONITORING SERVICES CAN BE - THE ONLY TRUE MONITORING SERVICE IS ONE THAT IS RIGHT NEXT TO OUR DATACENTER AND THAT IS PARCOM.

43. PARCOM MAINTAINS UP TO 30 DAYS OF RAW DATA LOG FILES TO ASSURE SERVERS DO NOT RUN OUT OF DISK SPACE FOR CUSTOMERS ON SHARED HOSTING PLANS.  IT IS THE RESPONSIBILITY OF THE CUSTOMER TO BACKUP THESE FILES IF THEY SO DESIRE.   HISTORICAL RECORDS ARE KEPT UP TO ONE YEAR VIA SMARTERSTATS OR AWSTATS.

44. resellers who wish to resell parcom services should become an authorized parcom reseller as that program is designed for resellers.  

IN SHORT IF YOU ARE GOING TO RESELL PARCOM SERVICES YOU MUST USE OUR RESELLER PLAN.  NO EXCEPTIONS.  you forfeit 100% support if you choose to resell (which means you are not the direct client).

REsell is fine if you are ok with no support.

45. THe use of DNS Zone editor is at the customers own risk. if problems occur due to changes outside the normal standard parcom settings, parcom will revert settings back to the default zone settings.   the use of outside mail via mx zone editing is acceptable but if this is done, the customer forfeits mail technical support from parcom for obvious reasons. 

46. resellers are responsible for supporting their own customers.   parcom does not provide sales or technical support to any reseller client.  YOU MUST ALSO BE AN AUTHORIZED RESELLER TO USE THE RESELLER CONTROL PANEL FOR CUSTOMERS.

47. resellers must use RESELLER domain name servers and cannot substitute outside name servers by using parcom IP addresses.  this can cause severe mail issues and will force parcom to suspend all reseller accounts if problems are caused by name server substitution.

48. PARCOM CANNOT SUPPORT CLIENTS RUNNING DOTNETNUKE, PHPNUKE, COMMUNITYSERVER, MAMBO, JOOMLA ETC. ON PLANS NOT DESIGNED FOR THOSE VERY POPULAR AND RESOURCE INTENSIVE APPLICATIONS.   PARCOM WILL RECOMMEND THE FIRST CLASS PLAN FOR THE CUSTOMER ACCOUNT.   THESE ARE NOT SUPPORTED DUE TO THE INTENSITY OF THESE APPLICATIONS.   THEY ARE BEST UTILIZED ON OUR FIRST CLASS OR ON DEDICATED SERVERS.

49. Parcom can change plans and offers without notice due to vendor or supplier changes.  

50. as of February 2006, the 2006 series of plans are limited to multiple accounts only if the domains are registered with Parcom.  UPDATE: Parcom did not restrict this during the months of February through November and does not retroactively convert accounts to accommodate this.  Effective the 22nd of November: if a customer needed an additional free account on a 2006 series plan, the domain must be registered with Parcom or pay a modest non-parcom domain registration service fee.  CUSTOMERS WITH DOMAINS REGISTERED ELSEWHERE AND ARE ALREADY ON THE 2006 PLANS DO NOT HAVE TO TRANSFER UNLESS THEY WISH TO TAKE ADVANTAGE OF FUTURE OFFERINGS OR ADDED BENEFITS.

51. PARCOM IS NOT RESPONSIBLE FOR ISPS THAT AFFECT THE PERFORMANCE OR USE OF parcom MAIL SYSTEMS.   MANY ISPS CONTROL THE USE OF OUTSIDE MAIL providers TO COUNTER SPAM AND FOR OBVIOUS REASONS.  IF A CLIENT HAS PROBLEMS SENDING MAIL THROUGH A PARTICULAR ISP, THE CLIENT AGREES TO WORK WITH THE ISP OR SELECT A NEW ISP THAT IS NOT restricting their use.  PARCOM PROVIDES ALTERNATIVE SMTP PORT idS TO SEND THROUGH VERY RESTRICTIVE ISPS, HOWEVER THIS IS A last resort that is unsupported BY PARCOM.

52. ALL PARCOM CUSTOMERS MUST USE SCRIPTS OR SOLUTIONS THAT AUTHENTICATE FOR THEIR Mailings from their site.   YOUR MESSAGES THAT ORIGINATE FROM YOUR SITE MUST BE FROM A VALID USER THAT YOU CREATED ON THE SYSTEM.   A PASSWORD MUST BE SENT VIA YOUR SCRIPT TO YOUR ASSIGNED MAIL SERVER.   OTHERWISE THE MESSAGE WILL BE DELETED.  THIS POLICY IS MANDATORY AS ANYTHING ELSE IS CONSIDERED SPAM.  IN OTHER WORDS, YOU CANNOT CREATE A FORM on your site and HAVE THE "FROM" FIELD BE POPULATED WITH A NON-PARCOM HOSTED DOMAIN E-MAIL ADDRESS (i.E. YOUR ISP OR FREE E-mAIL ACCOUNT OUTSIDE THE PARCOM NETWORK.)

53. PLANS THAT INCLUDE A FREE DOMAIN BELONG TO PARCOM IN TERMS OF ADMINISTRATIVE CONTACT AND BILLING.  DOMAINS CAN BE GIVEN TO A CUSTOMER AT ANYTIME THEY REQUEST IT BUT THEY WILL FORFEIT THE FREE REGISTRATION PART OF THE DEAL.  IF A CLIENT WISHES TO TAKE OWNERSHIP OR TRANSFER THE DOMAIN TO ANOTHER REGISTRAR (OR EVEN TAKE OWNERSHIP) THEY MUST PAY A FEE EQUIVALENT OF THREE YEARS OF OUR CURRENT RATE PRIOR TO TRANSFER.   THE YEARS WILL NOT TRANSFER TO OTHER REGISTRARS IN THESE SITUATIONS.

54. YOU MUST TRANSFER A DOMAIN WITHIN 30 DAYS TO RECEIVE THE FREE DOMAIN AS PART OF CURRENT ANNUAL PACKAGES THAT HAVE A FREE DOMAIN (.COM, .NET, .ORG, .INFO, OR .US)   AFTER 30 DAYS YOU CANNOT TRANSFER ONE TO BECOME A FREE DOMAIN.   aLSO, THE DOMAIN MUST BE THE PRIMARY DOMAIN OF THE PACKAGE, NOT A DOMAIN ALIAS OR PARKED DOMAIN.

55. due to the huge number of internet mail capable appliances (from phones to even kitchen appliances) parcom cannot possibly provide support for pop3 mail on a refridgerator for instance.   we provide the information necessary for you to utilize your mail client solution of choice but if you have difficulties you must go to the maker of the product for support.  this is especially true for "smartphones." (i.e. blackberry)

56. All MYSQL Databases cannot exceed 100MB in size.  This is to assure quality for all customers.  MICROSOFT SQL LIMIT IS 200MB IN SIZE. PARCOM RESERVES THE RIGHT TO SHUT DOWN ACCOUNTS THAT EXCEED THESE LIMITS TO PROTECT OTHER CLIENTS.  IN OUR EXPERIENCE IT IS BEST THAT LARGER DATABASES ARE HOUSED ON DEDICATED/VIRTUAL SYSTEMS.    PARCOM MAINTAINS A HIGHER STANDARD THAN ANY OTHER HOST AND THIS POLICY IS IMPORTANT TO ASSURE DATABASE SYSTEMS ARE ALWAYS AVAILABLE TO ALL WHO SHARE THEM.

57. MySQL is only supported with PHP at Parcom.  Microsoft SQL works well with ASP and ASP.NET.   Those are the two official combinations Parcom officially supports in terms of SQL.    For Microsoft Access, we only support the use of Microsoft scripting languages.   a common request is to use ASP with MYSQL, that is not supported.
